How to Search Civil Dockets
Start by classifying the court. The Upshur County District Clerk keeps 115th District Court civil, family, tax, Attorney General, DFPS, adoption, and juvenile files. The County Clerk holds County Court and probate records, and four JP clerks run the justice, small claims, and eviction dockets. For the County Clerk's covered judicial records dated March 1, 2025 forward, the Tyler UCMS portal is the current route. An older portal covers the earlier period. Neither replaces the District Clerk. A cause number is the best search key. Name searches often pull up similar parties, so confirm the court, filing date, case type, and status before trusting a match.
- Identify District Court, County Court, probate, or the correct JP precinct.
- Use the clerk's official current or legacy route for that court and date.
- Search by exact cause number or a narrow party name.
- Read filings, settings, orders, and disposition as distinct events.
- Contact the custodian for a missing image, public inspection, or certified copy.
Upshur District Civil Records
The 115th District Court is Upshur County's general-jurisdiction trial court. It also serves Marion County. So check the county on any calendar or result. District Clerk custody covers civil, family, tax, Attorney General, DFPS, adoption, juvenile, and other district matters. When you request a record, name the Upshur County case and its cause number. Specify the exact paper you want. A docket line is only a summary. The original petition states a claim, and an answer states a response. A motion merely asks the judge to act. The order records what the judge actually directed. Cases close by judgment, dismissal, nonsuit, agreed order, or another listed result. A closing line alone rarely tells the whole story. If an entry leaves your question open, ask the District Clerk for the filed document behind it.
What a Civil Docket Shows
Official Upshur County results vary in what they display, since each court and access rule sets its own limits. The inventory that follows lists the fields worth checking whenever you pull up a civil docket entry. It stands in for no single real case.
| Header | 115th District Court or other court, Upshur County, cause number, case style, type, filing date, and status. |
|---|---|
| Parties and counsel | Plaintiff and defendant roles, public party names, attorney names, and roles. |
| Register | Petition, service, answer, counterclaim, intervention, discovery, motions, mediation, hearing, order, judgment, or appeal. |
| Settings | Date, time, courtroom, hearing type, officer, result, and reset notation. |
| Documents | Title, filing date, image availability, and public-access status. |
| Disposition | Judgment, dismissal, nonsuit, settlement notation, final order, or appeal. |
Upshur County publishes no universal civil case-code format. Type the cause number exactly as the court shows it, and resist adding separators or a prefix of your own.
Upshur Civil Workload by Numbers
The Office of Court Administration tracked district activity from September 1, 2023 through August 31, 2024. Upshur County began the period with 1,261 active pending civil cases. Another 751 were added, and 819 were disposed. Then 1,184 were still pending at the end. The companion report showed a 109.1 percent clearance measure and a 1.5 backlog index. Those are administration figures. They say nothing about any party or how cases turned out.
Family cases get their own row: 725 added, 726 disposed, and 720 active pending at close. A workload total can never answer for one Upshur County case. Its docket and filed orders do that.
Types of Civil Cases on the Docket
Civil matters split by subject and by court authority. The District Clerk holds the district categories described above. The constitutional County Court has general probate jurisdiction. It also holds concurrent power within its statutory range. JP courts take justice and small claims matters along with evictions. Ask the wrong clerk and you may get an empty answer. Another Upshur County court could still hold the case.
| Court route | Typical civil docket | Record custodian |
|---|---|---|
| 115th District Court | Major civil, tax, family, DFPS, adoption, and related cases | District Clerk |
| Constitutional County Court | Probate and other matters within statutory authority | County Clerk |
| Justice courts | Justice, small claims, and eviction matters | Relevant JP clerk |
The individual JP pages state jurisdiction up to $20,000, yet a general county precinct page still says $10,000. Confirm the current limit with the court. Never average the two into a new figure.
Upshur Probate Starts With County Clerk
Probate in Upshur County runs through the constitutional County Court. Texas Government Code Section 26.330 spells that out. The statute also gives that court shared authority in certain other matters. For the clerk side of these court records, look to the County Clerk. That office is where a probate docket search should start, unless a filing itself points you to a different court.
There is a date split to know. Records through February 28, 2025 sit on the old judicial system. Anything from March 1, 2025 forward lives in Tyler UCMS. A separate legacy document index exists too. It searches recorded instruments by grantor, grantee, date, instrument number, book, volume, page, and type. That index is not a civil case docket, though. Finding a deed there proves nothing about a petition. Nor does it prove any court order in a case.
Settings and Hearings on Civil Dockets
A setting is a court event on the calendar, not a prediction of the outcome. Civil dockets can list motion hearings, mediation events, and pretrial settings. Bench or jury trials may appear too, along with probate hearings or reviews. Write down the court, county, date, time, and courtroom. Note the judicial officer, setting type, and status. Then look again later for a reset, continuation, cancellation, or result.
- Service
- Formal delivery of process or notice.
- Pleading
- A filing that states a claim or response.
- Motion
- A request for a court order.
- Reset or continuance
- A setting moved to another date.
- Nonsuit
- A displayed case-ending event that should be read with its filed order.
- Judgment
- A court decision that may grant relief, costs, or other terms.
A filed petition does not prove its claims true. A setting does not show who won either. For the answer, find the public order or judgment.
Upshur Civil Fees and Copies
The District Clerk's fee sheet sets $350 to open most new matters in Upshur County. The sheet is effective January 1, 2022. That covers a civil case, divorce, family case, adoption, or name change. Later pleadings or motions on the specified list cost $80 each. A jury fee runs $10. Copies are $1 per page, and certification adds $8 per document. The sheet carries that date. So confirm the current amount with the clerk before you file or pay anything.
| Office and item | Published amount | Caution |
|---|---|---|
| District Clerk, listed new civil case | $350 | January 1, 2022 schedule |
| District Clerk, copies | $1 per page | Confirm current charge |
| District Clerk, certified copy | $8 per document | Confirm current charge |
| County Clerk, certified copy | $5 plus $1 per page | Separate County Clerk schedule |
| County Clerk, authenticated copy | $7 plus $1 per page | Separate County Clerk schedule |
Do not merge the two offices' fee schedules: name the court and the document when you ask which one applies.
Public Access to Civil Dockets
Texas Rule of Civil Procedure 76a starts from a presumption. Covered civil court records are presumed open. Sealing them takes a specific showing, and the court must find no less restrictive means. Even so, the rule is not a universal answer. Adoption, juvenile, DFPS, family, and child-protection records can carry separate limits of their own.
Access rule: A public case index may coexist with a sealed or redacted document. Ask the clerk for the public portion and the order that governs access.
Privacy rules shape what a civil docket shows in Upshur County. Texas Rule 21c keeps sensitive identifiers out of filings. The Texas judicial records policy also explains Rule 12 access for qualifying judicial records. Case files themselves answer to the governing rules, statutes, and clerk procedures. One caution matters here. A missing online image is not proof the filing never happened.
The Texas specialty courts page lays out its own official information. It shows how the state presents these programs.

A specialty program may keep its own calendar. Its records still answer to the custodian and access rules of the underlying case.
Upshur Certified Judgment Requests
Gather your details before calling. Have the exact court, the Upshur County cause number, the case style, and the document title. Tell the clerk whether you need a plain, certified, or authenticated copy. District Clerk certification and County Clerk certification sit on separate schedules. An authenticated County Clerk copy is not the same request as a District Court certified judgment.
If Tyler UCMS returns nothing, check the March 2025 boundary. Also check whether the case sits in District Court or a JP court. Try re:SearchTX as a statewide layer, though its coverage has limits. The Upshur County case search explains more on names and court classification. A clerk can confirm what portion is public. The clerk can also give the current cost and how you will get the copy.
